Kevin Etzkorn

Founding Partner

Kevin Etzkorn has been a courtroom lawyer for more than 15 years. Kevin spent the first ten years of his career representing corporations, insurance companies, and hospitals in Missouri and Illinois. He eventually decided he could do more good by serving people than than he could by defending corporations.

In December 2014, he left a comfortable job at a large corporate law firm in order to start and run this firm with his brother. Since then, he has focused his practice on finding justice for those harmed by the negligent, reckless, and fraudulent acts of others. Given his experience as a corporate defense lawyer, Kevin has invaluable insight into how big businesses often mask or corrupt the truth and on what can be done to overcome their tactics.

Each year from 2013 to 2019, Kevin was named year as a Rising Star by SuperLawyers magazine. In 2020, Kevin was named a SuperLawyer by the same magazine, an award given to only 2.5 percent of attorneys. Kevin has also been selected to America’s Top 100 High Stakes Litigators.

Results

Kevin has achieved results in difficult cases in the fields of personal injury, medical malpractice, elder abuse/nursing home negligence, child abuse, and business torts. With each case Kevin accepts, he focuses on finding the best way to correct an injustice his client has suffered. Many times, this means negotiating a favorable result through an out-of-court settlement and, other times, it means trying the case to a jury. Below is a sample of some of the cases Kevin has tried in recent years:

  • Verdict for our client in trucking crash case. Our client’s car was knocked across the interstate by a semi. Our lawsuit revealed the trucker had exceeded the maximum work hours and was fatigued at the end of a long shift. The trucking company made no settlement offers and argued that our client was at fault. The reporting police officer testified our client was at fault. The jury discounted the officer’s testimony and rendered a verdict for our client.
  • Verdict for client in Missouri Merchandising Practices Act (“MMPA”) case. Our client had a dispute with an estate sale company. At trial, after less than an hour of deliberations, a unanimous jury awarded compensatory damages in favor of our client. The following day, the jury added punitive damages. Under the MMPA, we were allowed to submit attorneys’ fees as well. The case settled before a hearing over attorneys’ fees.
  • Trial of premise liability case. In this case, our client fell on the defendants’ property. He tore a rotator cuff, had major complications, and surgery. The case settled during trial.
  • Trial of medical malpractice case. This suit involved claims of paralysis due to a delayed diagnosis and treatment of a spinal infection. The case settled during the fourth week of trial.
  • Verdict for client in medical malpractice case. This was a two-week trial related to a stroke after a total knee replacement.
  • Verdict for client in premise liability case related to an ankle fracture in a fall at a hospital.
  • Verdict in auto accident case against client. Favorable settlement protected the client from the verdict.
  • Verdict in auto accident case where liability was in dispute. This case was tried twice with the first trial ending in a hung jury and the re-trial ending in a verdict for our client.
